Welcome to 95 Auto Club. These Terms and Conditions (“Agreement”) govern the rental of any vehicle from 95 Auto Club (“we,” “us,” “our,” or “Company”), an exotic and economy car rental company operating in Fort Lauderdale and Miami, Florida. By reserving or renting a vehicle from us, you (“Renter,” “you,” or “your”) agree to be bound by the terms set forth below. Please read this Agreement carefully before booking.
1. Eligibility and Driver Requirements
To rent an economy vehicle, the primary driver must be at least 21 years of age. To rent an exotic, luxury, or high-performance vehicle, the primary driver must be at least 25 years of age. All drivers must possess a valid, unexpired driver’s license held for a minimum of one year. International renters must present a valid passport and a valid driver’s license from their country of residence, along with an International Driving Permit where applicable. Every person who will operate the vehicle must be listed on the rental agreement and meet all eligibility requirements. Unauthorized drivers are strictly prohibited and will void all insurance coverage and this Agreement.
2. Reservations, Deposits, and Payment
A valid credit card in the primary driver’s name is required for all reservations. A refundable security deposit is required at the time of rental and will be held on the credit card until the vehicle is returned and inspected. Deposit amounts vary by vehicle class and are higher for exotic and luxury vehicles. Full rental payment is due at or before the start of the rental period. We accept major credit cards; debit cards, cash, and prepaid cards may be subject to additional verification or may not be accepted for exotic vehicles. The security deposit will be released after the vehicle is returned in its original condition, less any applicable charges for damage, fuel, tolls, tickets, cleaning, or late return.
3. Rental Period, Mileage, and Late Returns
The rental period begins and ends on the dates and times specified in your rental agreement. Rentals are charged on a 24-hour daily basis. A grace period of 60 minutes may be granted at our discretion; beyond that, late returns are subject to additional daily charges, hourly fees, or a full extra day’s rental rate. Each rental includes a specified daily mileage allowance, which varies by vehicle class. Exotic and luxury vehicles typically include a limited number of miles per day, with additional miles charged at a per-mile rate. Any extension of the rental period must be approved by us in advance and is subject to vehicle availability and additional charges.
4. Insurance and Financial Responsibility
The Renter is required to maintain valid automobile insurance that covers the rental vehicle, or to purchase coverage offered by us where available. You must provide proof of insurance prior to taking possession of the vehicle. The Renter is fully responsible for any and all damage to the rental vehicle during the rental period, regardless of fault, up to the full replacement value of the vehicle. This includes but is not limited to collision, theft, vandalism, fire, weather damage, and mechanical damage caused by misuse. In the event of an accident, the Renter is responsible for any insurance deductible, loss of use, diminished value, storage, towing, and administrative fees. Your credit card may be charged for damages, and the security deposit does not represent the limit of your liability.
5. Prohibited Uses of the Vehicle
The rental vehicle may not be used for any of the following: operating under the influence of alcohol, drugs, or any controlled substance; racing, speed contests, track use, or timed events; any illegal purpose or activity; transporting passengers or property for hire (including ride-share or delivery services) unless expressly authorized; towing or pushing any object or vehicle; off-road driving or driving on unpaved surfaces; carrying more passengers than the vehicle’s rated seating capacity; smoking or vaping inside the vehicle; transporting pets without prior authorization; or leaving the states of authorized operation without written permission. Vehicles may not be driven outside the United States. Violation of any prohibited use voids all coverage and makes the Renter fully liable for all resulting damages and losses.
6. Fuel, Tolls, Fines, and Additional Fees
Vehicles are provided with a full tank of fuel and must be returned with a full tank of the correct fuel grade. Vehicles returned with less fuel will be charged for refueling plus a service fee. The Renter is responsible for all tolls incurred during the rental period, along with any administrative fees for processing them. The Renter is solely responsible for all parking tickets, traffic citations, red-light and speed camera violations, and any related fines, penalties, and administrative charges assessed during the rental period. We reserve the right to charge the Renter’s card for these amounts as they are received. Excessive dirt, stains, odors, or the need for detailing beyond standard cleaning will result in additional cleaning fees.
7. Cancellations and Refunds
Cancellation policies vary by vehicle class. Reservations for economy vehicles may generally be cancelled with a full refund if cancelled at least 48 hours before the scheduled pickup. Reservations for exotic and luxury vehicles may require a longer cancellation notice and may be subject to a non-refundable deposit. Cancellations made after the applicable deadline, no-shows, and early returns are non-refundable. All refunds, where applicable, are processed to the original method of payment and may take several business days to appear. We reserve the right to cancel a reservation and issue a refund if the requested vehicle becomes unavailable due to damage, mechanical issues, or circumstances beyond our control.
8. Vehicle Condition, Return, and Breakdowns
The Renter acknowledges receiving the vehicle in good working condition and agrees to return it in the same condition, ordinary wear excepted. A vehicle inspection will be conducted at pickup and return, and the Renter is encouraged to review and document the vehicle’s condition at pickup. The Renter must promptly report any mechanical problems, warning lights, or damage. In the event of a breakdown, accident, or theft, the Renter must contact us immediately and, where applicable, the local police. The Renter must not attempt repairs or authorize service without our written consent. The vehicle must be returned to the agreed location; unauthorized drop-off at a different location will incur additional fees.
9. Limitation of Liability and Indemnification
To the fullest extent permitted by law, 95 Auto Club shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use of a rental vehicle, including but not limited to loss of income, inconvenience, or damage to personal property left in the vehicle. We are not responsible for personal belongings lost, stolen, or damaged before, during, or after the rental period. The Renter agrees to indemnify, defend, and hold harmless 95 Auto Club, its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorney’s fees, arising from the Renter’s use of the vehicle or breach of this Agreement.
10. GPS, Telematics, and Vehicle Monitoring
Some vehicles are equipped with GPS tracking and telematics devices that may monitor location, speed, mileage, and vehicle usage for security and operational purposes. By renting a vehicle, you consent to such monitoring. We reserve the right to locate and recover a vehicle that is used in violation of this Agreement, is overdue, or is reported stolen, at the Renter’s expense.
11. Privacy
We collect and use personal information provided during the reservation and rental process to fulfill your rental, verify identity, process payments, and comply with legal obligations. We do not sell your personal information. Please refer to our Privacy Policy for full details on how your information is collected, used, and protected.
12. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising out of or relating to this Agreement or a rental shall be subject to the exclusive jurisdiction of the state and federal courts located in Broward County or Miami-Dade County, Florida. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13. Changes to These Terms
We reserve the right to modify these Terms and Conditions at any time without prior notice. The version in effect at the time of your rental governs that rental. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
